DANIŞTAY’DAN ULUSAL STOK KARARI
Danıştay, bir akaryakıt dağıtım şirketinin açtığı davada, Petrol Piyasası Lisans Yönetmeliği΄nin Ulusal Stok düzenlemesine ilişkin 18. maddesinin 6. fıkrası ile bu maddeye göre kesilen idari para cezasının yürütmesini durdurdu. Karar, Ulusal Stok düzenleme yetkisinin EPDK΄da bulunmadığı, bu yetkinin EPDK΄ya devredildiğine ilişkin herhangi bir düzenleme bulunmadığı gerekçesiyle verildi. Danıştay Kararı uyarınca yürütmesi durdurulan Lisans Yönetmeliği 18. Maddenin 6. fıkrası şöyle:
"Ulusal petrol stoğu hesabında esas alınacak günlük ortalama ürün miktarı, bir önceki dağıtım projeksiyonu döneminde ikmal edilen akaryakıt miktarının 360’a bölünmesi suretiyle hesaplanır. Dağıtıcı lisansı sahiplerinin yükümlülükleri kapsamında tutulacak stok miktarı, 3.300 ton veya eşdeğeri hacim ölçüsünden az olamaz."
